Suit Against Mayor, DCGH Dismissed

A lawsuit filed against the county mayor and Decatur County General Hospital by a former Emergency Management Services director was dismissed late last month in federal court.
Larry Marshall, a 35 year veteran of the EMS, claimed that he was wrongly terminated in 2008 after exercising his First Amendment right to free speech.
Marshall filed suit in Federal District Court in July 2008, a month after being fired from his position as the county EMS Director. Marshall said he had reason to believe that the termination was in retaliation for criticisms made toward county government.
Marshall said he made several public comments regarding County Mayor Jason Scott prior to his termination.
The suit alleges Mayor Scott acted in retaliation against Marshall for exercising rights to free speech and political participation, and intentionally interfered with his employment relationship.
According to court documents, Marshall claimed that DCGH admitted Scott tried to persuade them to terminate Marshall’s employment because of the criticisms made against county government.
In its answer to the suit, the hospital denied that any alleged criticisms of the Decatur County government played any unlawful role in its decisions relating to Marshall.
Decatur County General Hospital also refuted allegations that it retaliated against Marshall on the basis of any activity protected by law.
Scott also denied any wrongdoing and said he had nothing to do with decisions made by the hospital board.
